Article 1 – Definitions
We / the seller: Gio's Bazaar. You / the consumer: a natural person who is not acting for purposes related to a trade, business or profession. Distance contract: a contract concluded through this website without both parties being physically present. Withdrawal period: the period within which you may cancel the contract (see article 6). Day: calendar day.
Article 2 – Applicability
These terms apply to every offer on this website and to every distance contract between us and you. You can read, save and print them before you order. If any provision is invalid, the rest of these terms remain in force. Mandatory consumer protection rules of the country where you live always apply where they give you more protection.
Article 3 – The offer
Our product descriptions and photos are complete and accurate to the best of our knowledge. Photos show the actual product as closely as possible, but small differences in colour may occur because of screen settings. Obvious mistakes or errors in an offer are not binding.
Article 4 – The contract
The contract is concluded when you complete your order and payment at checkout. We confirm your order by email straight away. We protect the electronic transfer of data and the payment environment with appropriate technical and organisational measures.
Article 5 – Prices and payment
All prices include VAT. Shipping is free. Prices do not change during the period of an offer, except for changes in VAT rates. You pay through the payment methods offered at checkout; payment is due when you place your order.
Article 6 – Right of withdrawal
You may cancel the contract without giving a reason within 30 days of receiving the product (the legal minimum is 14 days). Notify us by email or with the model withdrawal form in our Returns & Refund Policy, then return the product within 14 days of that notification. You pay the direct cost of returning the product. During the withdrawal period, handle the product with care and only to the extent needed to judge it; if you go beyond that, we may deduct the loss in value. We refund all payments received, including standard delivery costs, within 14 days of your notification, and may wait until we have received the product or proof that you sent it.
Article 7 – Exceptions to the right of withdrawal
The law allows us to exclude products made to your personal specifications, such as jewellery engraved with your own text, from the right of withdrawal. We do not use this exception: engraved and personalised pieces can be returned under article 6 as well.
Article 8 – Delivery
We deliver to the address you give at checkout. Delivery times are set out in our Shipping Policy: personalised jewellery is delivered in 1–2 business days in the Netherlands and 2–3 business days in Belgium, Germany and France; if you choose a back engraving, we engrave your piece to order first, and the engraving time is shown as soon as you choose it; for rings, please allow up to 14 days from your order to delivery, including processing. If we cannot deliver within 30 days or within an agreed period, we will tell you, and you may cancel the contract free of charge; we then refund you within 14 days. The risk of loss or damage passes to you when the product is delivered to you or to a person you have designated.
Article 9 – Rings and sizing
Sizes are given as US size, EU size and inside diameter in millimetres. Choosing the size is your responsibility; our size guide helps you measure correctly. A wrong size can be returned within the withdrawal period (article 6).
Article 10 – Conformity and statutory warranty
We guarantee that our products conform to the contract, the specifications in the offer, and the reasonable requirements of soundness and usability. You have the statutory rights that apply to consumer purchases: if a product turns out to be faulty, you are entitled to repair or replacement and, if that is not possible or not done within a reasonable time, to a price reduction or a refund. Normal wear (such as gradual patina on brass) and damage caused by improper use are not faults.
Article 11 – Liability
We are liable as provided by law. We are not liable for indirect damage, unless caused by our intent or gross negligence. This does not limit your statutory rights as a consumer.
Article 12 – Complaints
Please report complaints about a product or an order fully and clearly to info@giosbazaar.com as soon as possible after you discover the problem. A complaint made within two months of discovering a defect is always on time. We confirm receipt and give a substantive answer within 14 days. If a complaint needs more time, we will tell you within those 14 days when you can expect an answer.
Article 13 – Intellectual property
All texts, images, logos and other content on this website are protected and may not be copied or used without our permission.
Article 14 – Personal data
We process personal data as described in our Privacy Policy.
Article 15 – Applicable law and disputes
Dutch law applies to these terms and to every contract with us. If you live in another country, you keep the protection of the mandatory consumer rules of that country. We always try to solve disagreements together first. If that does not work, you may bring the dispute before the competent court in the Netherlands or in the country where you live.
