Article 1 – Definitions
In these terms and conditions, the following is understood to mean:
Entrepreneur: Gio's Bazaar, the natural or legal person who offers products to consumers remotely.
Consumer: the natural person who does not act in the exercise of a profession or business.
Distance contract: an agreement in which, within the framework of a system organized by the entrepreneur for distance selling, exclusively one or more techniques for distance communication are used up to and including the conclusion of the agreement.
Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period.
Day: calendar day.
Article 2 – Applicability
Deze algemene voorwaarden zijn van toepassing op elk aanbod van de ondernemer en op elke tot stand gekomen overeenkomst op afstand tussen ondernemer en consument.
De tekst van deze algemene voorwaarden wordt aan de consument beschikbaar gesteld voordat de overeenkomst op afstand wordt gesloten. Indien dit redelijkerwijs niet mogelijk is, zal vóór het sluiten van de overeenkomst worden aangegeven waar de algemene voorwaarden kunnen worden ingezien en dat zij op verzoek van de consument kosteloos worden toegezonden.
Article 3 – The Offer
The offer contains a complete and accurate description of the products offered.
Obvious mistakes or errors in the offer do not bind the entrepreneur.
Every offer contains such information that it is clear to the consumer what the rights and obligations are that are associated with the acceptance of the offer.
Article 4 – The Agreement
The agreement is concluded at the moment of acceptance of the offer by the consumer and compliance with the conditions set out therein.
If the consumer has accepted the offer electronically, the entrepreneur shall immediately confirm receipt of the acceptance electronically.
The entrepreneur shall take appropriate technical and organizational measures to secure the electronic transmission of data.
Article 5 – Right of withdrawal
The consumer has the right to terminate the agreement within 30 days of receipt of the product without giving reasons.
The consumer exercises the right of withdrawal by notifying the entrepreneur in writing or by email within the cooling-off period.
After withdrawal, the consumer has 30 days to return the product. The costs of return shipping are at the consumer's expense.

Article 6 – Exceptions to withdrawal
Withdrawal is excluded for products:
That have been manufactured according to the consumer's specifications (custom-made or personalized).
That are not suitable for return for hygienic or health reasons and whose seal has been broken.
Article 7 – Prices
The prices stated in the offer include VAT.
During the validity period of the offer, prices will not be increased, unless statutory price increases (such as VAT changes) require it.
Article 8 – Payment
Payment must be made via the payment methods offered on the website.
The consumer is obliged to report inaccuracies in provided payment details without delay.
Article 9 – Delivery and Execution
The entrepreneur will exercise the utmost care when receiving and executing orders.
The delivery period is a maximum of 30 days, unless otherwise agreed.
Since Gio's Bazaar uses dropshipping, the delivery time may vary from 7 to 21 working days.
If delivery is delayed or proves impossible, the consumer will be notified of this in a timely manner. In that case, the consumer has the right to terminate the agreement free of charge and will receive a full refund of the purchase amount.
Article 10 – Warranty and conformity
The entrepreneur guarantees that the products comply with the agreement, the specifications stated in the offer, and reasonable requirements of soundness.
Any manufacturer's warranties apply as stated by the supplier or manufacturer.
Article 11 – Liability
The entrepreneur is not liable for indirect or consequential damages, unless there is intent or gross negligence.
In any event, the entrepreneur's liability is limited to the amount of the order of the relevant consumer.
Article 12 – Complaints Procedure
Complaints regarding the execution of the agreement must be submitted within 7 days after delivery, fully and clearly described, via info@giosbazaar.com
The entrepreneur will provide a substantive response within 14 days of receipt of the complaint.
If a complaint cannot be resolved through mutual consultation, a dispute arises that falls under the dispute resolution procedure.
Article 13 – Intellectual property
All texts, images, logos, and other content on the Gio's Bazaar website are protected by copyright and may not be copied or used without permission.
Article 14 – Applicable law and disputes
All agreements between the entrepreneur and the consumer are governed exclusively by Dutch law.
Disputes shall be submitted to the competent court in the Netherlands.
